According to Social Security Matters, you can collect benefits on your former spouse’s record if your later marriage ended by annulment, divorce, or death. However, if you’re entitled to your own benefits, your amount must be less than your ex-spouse’s.

Timing is Everything

You can apply for an ex-spouse’s benefits even if they haven’t retired, as long as you divorced at least two years before applying. If you wait until full retirement age to apply, your benefit will be half of your ex-spouse’s full retirement amount or disability benefit.
